Terms & Conditions of Service
1. Agreement to Terms
By engaging in services provided by Adheft Marketing ("Company," "we," "our," or "us"), the Client ("you," "your") agrees to the following terms and conditions. These terms govern the services provided by Adheft Marketing and form a legally binding agreement between you and the Company.
2. Service Commitment
All services provided are subject to a minimum six-month commitment. Upon completion of the initial six-month term, services will continue on a month-to-month basis unless canceled with a 30-day written notice.
3. Payment Terms
Payments are made through auto-pay via ACH or credit card. The first payment is due at the commencement of work. Ad management fees are either the quoted price or 30% of the managed ad spend, whichever is greater, per platform.
4. Cancellation Policy
A 30-day written notice is required for cancellation after the initial six-month term. Failure to provide the required notice will result in continued billing for the notice period.
5. Performance & Adjustments
If barriers to achieving expected results are identified, Adheft Marketing may offer alternative services in place of the standard ongoing work at our discretion. The effectiveness of marketing efforts depends on various factors, including market conditions, competition, and client cooperation.
6. Client Responsibilities
The Client must provide necessary access, approvals, and resources required for marketing campaigns. Delays in providing requested assets or approvals may impact performance and do not relieve the Client from payment obligations.
7. No Guarantee of Results
While Adheft Marketing aims to achieve the best possible outcomes, we do not guarantee specific results, leads, or revenue increases. Digital marketing success depends on multiple external factors beyond our control.
8. Limitation of Liability
Adheft Marketing shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services. The Client assumes all risks associated with digital marketing campaigns.
9. Confidentiality
Both parties agree to keep all proprietary and confidential information obtained during the course of this engagement strictly confidential.
10. Modifications to Terms
Adheft Marketing reserves the right to update or modify these Terms of Service at any time. Clients will be notified of any significant changes.
